Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website takshfin.com and all related services, tools, and features (collectively, the “Service”) operated by Taksh Fin (“we”, “our”, or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Taksh Fin is a home finance facilitation platform that connects home loan borrowers, real estate agents, and lending institutions (banks, NBFCs, and housing finance companies). We provide:

  • A loan enquiry and consultation service for home buyers.
  • A referral and CRM platform for real estate agents.
  • A lead sourcing channel for our lending partners.

Taksh Fin is not a bank, NBFC, or lending institution. We do not sanction, disburse, or guarantee any loan. All credit decisions are made solely by the lending partner to whom your application is submitted.

2. Eligibility

You may use the Service only if you:

  • Are at least 18 years of age.
  • Are a resident of India or an NRI seeking a home loan for property in India.
  • Have the legal capacity to enter into a binding agreement.
  • Are not prohibited from using the Service under applicable law.

3. Accounts

Certain features of the Service (the agent CRM platform) require you to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@takshfin.com if you suspect any unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Provide false, misleading, or inaccurate information in any form or application.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Use the Service to solicit, collect, or store personal information about other users without their consent.
  • Attempt to gain unauthorised access to any part of the Service or its related systems.
  • Use automated tools (bots, scrapers, crawlers) to access or extract data from the Service.
  • Engage in any activity that interferes with or disrupts the Service or its infrastructure.
  • Use the Service for any purpose that violates applicable Indian law, including the Information Technology Act, 2000.

5. Loan Referral — No Guarantee of Approval

When you submit a loan enquiry, you authorise Taksh Fin to share your information with one or more lending partners on our panel for the purpose of evaluating your loan eligibility. Submission of an enquiry does not constitute a loan application, and receiving a pre-approval indication does not guarantee final loan sanction. Lending decisions are subject to the lender's own credit policy, documentation verification, and regulatory requirements.

Taksh Fin does not charge borrowers any fee for the consultation or referral service. Agent commissions are paid by lending partners upon loan disbursement and are subject to a separate agreement between the agent and Taksh Fin.

6. Not Financial Advice

Nothing on the Service constitutes financial, legal, tax, or investment advice. Information provided — including indicative interest rates, EMI calculations, and eligibility assessments — is for general guidance only and may not reflect actual terms offered by any lender. You should seek independent professional advice before making any financial decision.

7. Intellectual Property

All content on the Service — including text, graphics, logos, icons, and software — is the property of Taksh Fin or its licensors and is protected by applicable intellectual property law. You may not copy, reproduce, distribute, or create derivative works from any content on the Service without our prior written consent.

8. Third-Party Services

The Service integrates with or links to third-party services including Google (authentication), lending partner portals, and property listing platforms. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the content, accuracy, or practices of any third-party service.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Taksh Fin shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of revenue, or loss of goodwill. Our aggregate liability to you for any claim arising from the Service shall not exceed ₹10,000 or the amount you paid to us in the preceding 12 months, whichever is lower.

11. Indemnification

You agree to indemnify and hold harmless Taksh Fin, its officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India. You agree to first attempt to resolve any dispute informally by contacting us at hello@takshfin.com.

13. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes by updating the effective date above and, where appropriate, notifying registered users by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.
